Punta Cana Terms and Conditions
By acceptance of and participation in any trip, Participant (defined as primary participant, secondary participant, or any person participating in the trip) agrees to release and hold harmless NuTech Seed, LLC, Corteva Agriscience and TR International, Inc., and their respective subsidiaries, affiliates, suppliers, distributors, advertising/promotion agencies, and prize suppliers, and each of their respective parent companies and each such company’s officers, directors, employees and agents (collectively, the “Released Parties”) from and against any claim or cause of action, including, but not limited to, personal injury, sickness, disease, death, or damage to or loss of property, arising out of participation in this program or receipt or use or misuse of any prize.
In order to participate in the trip for two in the trip promotion sponsored by the Released Parties, participant, for him/herself, heirs, executors, and administrators, waives, releases, discharges, and agrees to hold harmless NuTech Seed, LLC, Corteva Agriscience and TR International, Inc., and their respective officers, directors, employees, agents, successors and assigns, and anyone authorized by any of them, from any and all losses, damages, costs, expenses, rights, claims, demands and actions which Participant, his/her heirs, executors or assigns may have arising from participation in and/or my use of the trip in the promotion, including but not limited to personal injuries, sickness, disease, death, disability, property damages, and attorneys’ fees and expenses for litigation and settlement.
Participant expressly acknowledges for him/herself, heirs, executors, and administrators the existence of the global Covid-19 pandemic and potential for exposure and infection due to participation in the trip for the promotion sponsored by the Released Parties.
Except where prohibited, participation in the trip promotion constitutes each participant’s consent to NuTech’s and its agents’ use of participant’s name, likeness, photograph, voice, opinions and/or hometown and state for promotional purposes in any media, worldwide, without further payment or consideration.
NuTech Seed, LLC reserves the right to disqualify participants for trip participation at its own discretion. Participant agrees that NuTech Seed, LLC, Corteva Agriscience and TR International, Inc., have neither made nor are in any manner responsible or liable for any warranty, representation, or guarantee, expressed or implied, in fact or in law, relative to any prize, including but not limited to its quality, merchantability, fitness for particular purpose, or mechanical condition. Participant warrants that he/she is 21 years of age or older and has every right to contract in his/her own name.
Trip Rules
- All participants must be 21 years of age at the time of the trip and have a valid state ID, driver’s license, or passport for the duration of the trip.
- Trip participant must be a NuTech customer or a related family member or business associate (e.g., farm employee or a family partner of the qualifying NuTech customer).
- Credits used to qualify can only be used towards a single customer. Credits are nontransferable.
- A trip holder charge of $6,400 will be applied to the registrant’s SeedWare account.
- Trip credit will be awarded at account settlement and will be based off 2021 final paid for units.
- Failure to qualify will result in a $6,000 charge per couple.
- Each registrant is required to pay a nonrefundable $150 registration fee ($300 per couple).
- Registration is not confirmed until the $150 registration fee is received.
- Participants may receive a 1099 depending on their trip qualification.
- NuTech Seed reserves the right to disqualify participants for trip at NuTech’s sole discretion.
- The trip starts when flights depart. All travel expenses incurred before or after the trip dates are at the participant’s expense. NuTech will not cover costs such as lodging before or after the trip, meals or airport parking.
- Fees related to flight or travel changes after flights have been assigned are to be paid by the participant.
- Late registration may result in additional costs incurred at the participant’s expense.
- Any participants extending their stay are responsible for all other incremental costs of their extension.
- All flights must be booked through NuTech’s designated travel agency, TR International.
- If flight cancellations or changes occur within 48 hours of departure due to weather or other reasons, participants must work directly with the airline they are traveling on to be reassigned on new flights.
- NuTech will not cover the cost of an airline ticket if a participant purchases one on their own.
- NuTech has the right at its sole discretion to cancel the trip due to any reason that NuTech deems reasonable including but not limited to; Multi-Regional Epidemic cases in the United States, lack of interest in traveling by customers or other reasons.
